TP/5110/2024 (E-filing) WITH WILL/536/2025 Mr. Malcolm Vaz i/b. Sanjay Rego, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Anil Parsram Advani being sole surviving Executor named under the Will of deceased. The deceased namely Savitri Parsram Advani died at Mumbai on 16.02.2004. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 15.06.2024 since, identification proof of deceased is not available. The same is accepted.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 25.02.1989. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of husband of deceased as first executor and failing him the son will be the Executor. The husband of deceased namely late Parsram Advani died on 05.12.1994 and death certificate is separately uploaded with the praecipe dated 18.09.2025 hence, petitioner is sole surviving executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one son only who is petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Arjan Bhagwan Advani dated 14.03.2024 one of the Attesting Witnesses to the Will is filed. Affidavit of Service of General Citation dated 12.12.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
