TP/5118/2024 (E-filing) Ms. Sweta Moghe, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Shailesh Bijoor being sole surviving Executor named under the Will of deceased. The deceased namely Kiran Venugopal Kodikal died at Mumbai on 25.04.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 24.07.2012. The said Will is in English language. The Para No. 11 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and another executrix namely Lakshmi Murali was not co-operating hence, this Hon'ble Court passed an order dated 10.10.2025 in Interim Application No. 2520 of 2025 which was allowed in terms of prayer clause (A). The prayer clause (A) states that the Notice be issued to the second executrix namely Lakshmi Murali to remain present in the court and in default of appearance, the Court may proceed to grant the Probate to the petitioner. Residuary clause in respect of properties of deceased is mentioned at para No. 10 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by his widow and two sons who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Shailesh Bijoor dated 25.09.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 26.11.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
