Advocate for the Petitioner 202400002) 1) This petition is filed by petitioner, being constituted attorney of the one of the beneficiaries under the Will executed by Kanta Maganlal Bhardwa (herein after the same is referred to as "Testatrix"), for grant of a Letters of Administration with Will annexed. Said Testatrix said to have died at Hounslow, London on 21-02-2024. Petitioner, namely Satnaam Singh Darshan Singh Gabadia, filed the copy of death certificate, identity proof of the testator, Will, petitioner's oath.

3) Upon perusal of the Will (Ex.B) it appears that there is reference of the earlier will dated 20.02.2003 and 05.05.2009.

4)The petitioner is silent about these two Will, in his petition. In the Exh.B, it is stated that the earlier Will dated 20.02.2023 is cancelled. However, in the earlier petition, having No. 5072/2024, the testator has relied upon the said Will. Hence, the petitioner to explain that the Will dated 20.02.2023 is revoked or it is subsisted. The petitioner has not explained anything about the earlier Wills, in the petition. Furthermore, the petitioner to explain that whether the earlier Will is revoked or present Will is supplementary to the earlier Will. 5) Hence, the petitioner to mentioned about the all Wills, which are executed by the deceased and not revoked. Furthermore, the petitioner to produce the copies of these Will/s, as per Rule 385 of the Bombay High Court (OS) Rules, 1980. Tile is not amended by obtaining order.
