TP/5177/2024 Mr. Amogh Patkar a/w. Akshata Deshpande i/b. Rishi Ashok B., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Nirmal Kumar Bathwal and Ashok Kumar Bathwal both being Executors named under the Will of deceased. Deceased namely Hari Krishan Bathwal said to have died at Mumbai on 03.10.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 22.05.2015. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by widow, three sons and one daughter. Out of them two sons are petitioners herein and all other legal heirs have given their consents in favour of the petitioner except daughter of deceased namely Bandana Maskara.

4. Petitioner's oath is filed. Affidavit of Chandraprakash K. Doshi dated 23.07.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 26.03.2025 is filed.

5. Upon perusal of petition, it is noticed that consent Affidavit of daughter of deceased namely Bandana Maskara is not file. Hence, Advocate to take steps. Remove from board.
