TP/5179/2024 (E-filing) Ms. Snehal Marathe, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vilas Vishnu Joshi being one of the Executors named under the Will of deceased. The deceased namely Shantaram Narayan Kozarekar died at Mumbai on 15.01.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.10.2023. The said Will is in Marathi language hence, translation of the said Will alongwith Affidavit of Advocate dated 05.02.2025 certifying that the true and correct translation of the Will. The Page Nos. 2 of the Will refers to the appointment of Executors. Only four Executors appointed under the Will. Petitioner is one of the executors and other executors namely Sanjay Joshi, Hema Siddhaye and Madhav Joshi have filed their Affidavits dated 09.07.2024, dated 10.07.2024 and dated 10.07.2024 for reserving their rights to act as an Executors respectively.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased predeceased the deceased who died as bachelor. Deceased was survived by one sister, ten nieces and three nephews. Out of them one nephew is petitioner herein and consent Affidavits Hema Abhyankar and Veena Soman are not filed and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Swapnil Satish Sawant dated 09.07.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 28.01.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 15.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
