TP/5180/2024 (E-filing) Mr. Babu M. B. i/b. Ajay Panicker, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Harish Ramchand Punjabi being sole Executor named under the Will of deceased. The deceased namely Vandana Jawahar Punjabi died at Hongkong on 09.04.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.
2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 30.06.2023. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of alternate Executor who is petitioner herein. First Executor namely Jawaharlal Punjabi has not act as an executor because of his old age and Affidavit dated 09.08.2024 is filed to that effect. Therefore, he is deemed to have his right to reserve as an Executor. Hence, prayer clause of the petition is required to be corrected. Therefore, the Ld. Advocate for petitioner seeks leave to correct the prayer clause of the petition. Leave is granted to correct the prayer clause referring to the Reserving the rights of the another executor. Ld. Advocate for petitioner to carry out corrections within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner to re-upload the corrected petition on the official portal of the Bombay High Court.
3. Ld. Advocate for petitioner submits that deceased was survived by husband and one daughter who have given their consents in favour of the petitioner herein. Consent Affidavits are on record. There are no other legal heirs.
4. Petitioner's oath is filed. Affidavits of Harish Ramchand Punjabi and Geeta Harish Punjabi dated 09.08.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 19.12.2024 is filed. All other legal formalities are complied with. Hence, petition is granted.
5. Office to issue Probate as soon as uploading the corrected petition on the official portal of the Bombay High Court and after verifying whether any cross petition is filed or whether any caveat is filed. 18.09.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
