TP/5207/2024 (E-filing) Mr. Praful S. Pawar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. Upon perusal of petition, it is noticed that there is another Probate Petition is filed being TP No. 325 of 2003 granted to K. Thomas Babu on 20.01.2005 as sole Executor of Will dated 23.02.2001 of the deceased. Copy of the said grant is annexed to the petition as Exhibit - "D".

2. Ld. Advocate for petitioner states that as per para No. 12 of the petition, the petitioner has stated that there is no residuary clause in the said Will. Petitioner has now found some new securities which are in the name of deceased therefore, the petitioner has filed the present petition as the securities mentioned in the Schedule hereto are not covered by the Probate issued by this Hon'ble Court. Hence, Succession Certificate is proceeded with.

3. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Dipti Rameshchandra Vyas being daughter of deceased. Deceased namely Rameshchandra Girdharilal Vyas died intestate at Mumbai on 09.04.2001. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is already annexed to the petition.

4. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by three daughters and four sons. Out of them one daughter is petitioner herein and other two daughters and four sons have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

5. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 27.01.2025 and Administration Bond dated 18.07.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.

6. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed. 06.10.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
