1. In earlier petition, filed by Gururaj Yuvraj Saranth alias Gururaj Yuvraj Sawant for the similar properties. Misc. Petition, having No. 93/2015, came to be filed for re-vocation of the grant, issued in the TP No. 58/2010. In the said proceeding, parties arrived at compromised and accordingly, executed the consent terms. In the said consent terms, Petitioner has undertaken to the Hon'ble Court vide Paragraph No. 10, 12, 13, 14, 17, that he will not claim any property, which was subject matter of the said petition and he has received the amount under the compromise. Hence, it appears that properties, which are mentioned in the present petition, are also part of the earlier grant, issued in TP No. 58/2010. Hence, this petition will be cross-petition to the said petition. Furthermore, if this petition takes further, it would be breach of the undertaking given to the Hon'ble Court, as per the Order dated 10.07.2023. Hence, in such circumstances, it would be proper to adjourn the petition and re-check all these circumstance. Hence, adjourned.
