TP/5290/2024 (E-filing) WITH WILL/2118/2024 Mr. Prabhu Velar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Amit Kanakraj Khajanchi being sole Executor named under the Will of deceased. Deceased namely Kanakraj Sohanraj Khajanchi alias Kanakraj S. Khajanchi alias Kanak S. Khanjanchi said to have died at Mumbai on 11.08.2018. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 19.06.2017. The said Will is in English language.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Wife of deceased died on 03.12.2019. Deceased was survived by one son and two married daughters. Out of them son is petitioner herein and both the married daughters have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mandar Mahadev Dawal dated 02.08.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 16.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
