TP/5311/2024 (E-filing) Ms. Tanmayee Salekar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Meena Raju Chainani being sole surviving Executor named under the Will of deceased. Deceased namely Kishore Kanayalal Khatwani alias Kishore K. Khatwani alias K. K. Khatwani alias Kishor Kanayalal Khatwani alias Kishor K. Khatwani said to have died at Mumbai on 29.12.2013. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 26.06.2012. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. One son of deceased namely Amit Kishore Khatwani expired on 19.05.2023, died leaving behind one daughter namely Saachi Neha Amit Khatwani. The Amit Khatwani and his wife Shalini Khatwani had divorced and copy of Divorce Judgment dated 27.07.2017 is annexed to the petition at Exhibit - "G". Deceased was survived by widow, one son and one granddaughter who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ganesh Shivram Swami dated 07.08.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
