TP/5338/2024 (E-filing) Mr. Chaitanya Sharma i/b. Shah Ashwin Liladhar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Nilesh Subhashchandra alias Subhashbhai Kothari being son of deceased. Deceased namely Snehlata Subhashchandra Kothari died intestate at Mumbai on 03.06.2004. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that husband and parents of deceased predeceased the deceased. One son of deceased namely Chandreshkumar Subhashchandra alias Chandresh Kothari predeceased the deceased, leaving behind one son only and had no daughter. Deceased was survived by one son, two daughters and one grandson. Out of them son is petitioner herein and all other legal heirs have given their consents. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 20.01.2025 and Administration Bond dated 28.01.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
