Advocate for petitioner seeks leave to correct the first name of petitioner from 'Vidhyadhar' to "Vidhyadar". The said corrections are allowed. Ld. Advocate for petitioner to carry out the corrections within four weeks from the date of uploading of this order. Ld. Advocate for petitioner to re-upload the corrected petition on the official portal of the Bombay High Court.
2. This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioner namely Vidhyadar Pandharinath Bhatte being son of deceased. Deceased namely Malti Pandharinath Bhatte died intestate at Mumbai on 24.08.2017. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.
3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by two sons and one daughter. Out of them one son is petitioner herein and all other legal heirs have given their consents. Consent Affidavits are on record. There are no other legal heirs.
5. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 24.01.2025 and Administration Bond 24.01.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
5. Office to issue Succession Certificate as prayed as soon as the corrected petition is uploaded on the official portal of the Bombay High Court and after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed.
