TP/5399/2024 (E-filing) Mr. D. R. Mishra, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Taruna Arunkumar Parmar and Rekha Kishorbhai Shah both being Executrices named under the Will of deceased. The deceased namely Shantaben Arunkumar Parmar died at Mumbai on 16.05.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 24.02.2016. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only two Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. One son of deceased namely Virendra died on 23.12.2010, leaving behind two sons. One son of Virendra namely Harsh died on 08.10.2020 as bachelor. Deceased was survived by two daughters, one son and one grandson. Out of them both the daughters are petitioners herein and remaining legal heirs have served the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 18.02.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Nilesh Natwarlal Shah dated 07.08.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 03.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
