Heard Mr. Shaikh, learned Advocate for Petitioner. 2.
Requisition in the order dated 05.12.2024 is placed before me. Learned Advocate informs the Court that surety on behalf of person residing in New Delhi has already been filed in the office. Only in view of the provisions of Rules 399 and 420, the same shall be accepted by the Court as adequate compliance in view of exigency mentioned by Petitioner that he does not know any person within the territorial jurisdiction of this Court for filing the surety. 3.
Learned Advocate would submit that he has verified and there is no cross Petition whatsoever filed and hence dispensation of the requisition in clause Item No.3 is also complied with.

I am informed by the learned Advocate that requisition in Item No.1 has already been complied with and citation has been already issued.

In that view of the matter, office shall proceed with issuance of grant considering that there are only two legal heirs of the deceased who have filed their Affidavits.
