This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioners namely Aldrin Remedios Fernandes, Nadia Regina D'souza, Lukue Mariano Fernandes and Tania Felicia Stewart being sons and daughters of deceased. Deceased namely Agostinho Piedade Fernandes died intestate at Mumbai on 08.01.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. First wife of deceased namely Margaret divorced before the death of deceased by an order dated 14.03.1997 in M.J. Petition No. 420 of 1994 of this Hon'ble Court. Sons and daughters mentioned in para No. 4 of the petition are the legal heirs from the first wife. After divorced, deceased remarried to Daisy in 2021. Deceased had no issue from the second wife. Deceased was survived by widow, two sons and two daughters. Out of them two sons and two daughters are petitioners herein and widow has given her consent in favour of petitioner. Consent Affidavit is on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 17.01.2025 and Administration Bond dated 12.02.2025 are filed. All other legal formalities are complied with. Hence, petition is granted.
