1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Rashmikant Sobhagchand Bhodia being brother of deceased. Deceased namely Prafullben Vijaykumar Kothari died intestate at Rajkot, Gujarat on 02.09.2008. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 04.03.2024 for non-availability of identification proof of deceased which is already annexed to the petition. The same is accepted.

2. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Husband of deceased had one brother and one sister however, they died as bachelor and spinster. There are no legal heirs from the husband side of deceased. Deceased was survived by one brother who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 28.11.2025 is filed. As sole surviving legal heir of the deceased is petitioner before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
