TP/5524/2024 (E-filing) Mr. S. G. Bhandary i/b. Bhandary and Bhandary, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mohamed Rafi Sheikh being sole Executor named under the Will of deceased. The deceased namely Kamaljeet Mohansingh Khatri died at Mumbai on 16.12.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 05.12.2023. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one adopted son who is petitioner herein. There are no other legal heirs. Petitioner has filed Affidavit dated 23.06.2025 stating therein that petitioner has surviving adopted son and has annexed the Affidavit of Adoption dated 19.12.1985 to the Affidavit of petitioner. The same is accepted.

4. Petitioner's oath is filed. Affidavits of Parshottam Lal Narula and Mukesh B. Ahuja both dated 16.07.2024 the Attesting Witnesses to the Will is filed. Affidavit of Service of General Citation dated 28.02.2025 is filed. Administration Bond is not filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for grant. Hence, remove from board. 25.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
