TP/5525/2024 (E-filing) Mr. Sudhir Yadav i/b. Nisarg, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Shreyansh Ramniklal Parekh and Jinesh Ramniklal Parekh being surviving Executors named under the Will of deceased. The deceased namely Surajben Ramniklal Parekh died at Mumbai on 20.08.2013. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 30.06.2009. The said Will is in Gujarati language and translation of the said Will is annexed to the petition alongwith the Affidavit of Advocate for petitioner dated 04.04.2024 certifying the true and correct translation of the said Will. The Para No. 3 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will. Both the petitioners are executors and remaining executor namely Hemant Ramniklal Parekh died on 10.02.2017 as stated in para 8 of the petition.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. One son of deceased namely Hemant died on 10.02.2017 leaving behind two sons. Deceased was survived by two sons, one daughter and two grandsons. Out of them two sons are petitioners herein and the daughter and two grandsons have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mahesh Shantilal Shah dated 02.04.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 17.01.2025 is filed. All other legal formalities are complied with. Hence, peti5525tion is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
