TP/5540/2024 (E-filing) Ms. Hiral Thakkar i/b. Krishna Thacker, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Shankar Giridhar Masurkar being sole Executor named under the Will of deceased. The deceased namely Urmila Giridhar Masurkar died at Mumbai on 27.09.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 24.04.2019. The said Will is in Marathi language and translation of the said Will is annexed to the petition. Affidavit of Advocate for translation of the Will is not annexed to the petition. The Para No. 4 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by one daughter and two sons. Out of them one son is petitioner herein and another son has given his consent in favour of the petitioner. Consent Affidavit is on record. Daughter of deceased has been served with the citation and Affidavit of Service of Citation dated 24.02.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Sulochana Divakaran dated 02.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 01.03.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 09.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
