Heard Dr. Talankar, learned Advocate for Petitioner. 3.

Petition seeks issuance of Letters of Administration with Will annexed of property and credits of deceased. There are three beneficiaries under the said Grant. Petitioner is the only beneficiary who is alive. Other two beneficiaries namely Jayashree Narayan and L. Vijaykumar have expired in 2022 and 2018. All such details, averments, supporting documents are appended to the Petition by Petitioner.

The beneficiaries who are deceased did not have any legal heirs. Jayashree Narayan was a divorcee and did not have any issue. Decree is appended to Petition. Nandakumar the second beneficiary

P8.TP.5557.2024.doc was a bachelor. He has deserted the family for the past 30 -32 years. Citation has already been served on him through publication. Nothing more is required to be done.

In that view of the matter, the fact of unavailability of Nandakumar as also death certificate appended at page No.34 is noted by the Court to record the fact of demise of Nandakumar. 6.

In view of the above, there can be no impediment in allowing Grant to Petitioner who is daughter of the deceased. All office objections are dispensed with.

Petition stands allowed in terms of prayer and relief sought for in the Petition.

Department is directed to issue the Grant in accordance with law subject to all compliances by Petitioner within a period of four weeks from today.
