1. Read praecipe dated 04.03.2025, by which, Ld. Advocate for the Petitioner prays for issuance of summons to the attesting witnesses. Praecipe was moved before the Hon'ble Court and the Hon'ble Court directed the Testamentary Department to attend the same.

As attesting witnesses have not filed the affidavit which is required as per the provisions of the BHC Rules, 1980. It will be proper to issue summons to the attesting witness of the Will, according to Rules.

2. Accordingly, office is directed to issue witness summons. Ld. Advocate for the Petitioner to give details of the attesting witnesses to the office for issuance of summons. Hence, adjourned.
