TP/5563/2024 (E-filing) Mr. Vivek Pawar i/b. Shivaji Nirmale, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mahendra Madhusudan Shirodkar being sole Executor named under the Will of deceased. The deceased namely Malini Madhusudan Shirodkar died at Mumbai on 29.11.2011. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 06.04.2011. The said Will is in Marathi language and translation thereof is annexed to the petition and Affidavit of Advocate on record for translation is not filed to that effect certifying that the said translation is true and correct. The last para of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased was survived by two sons. Out of them one son is petitioner herein and another son namely Moreshwar, whose whereabouts are not known therefore, newspaper publication is done and Affidavit dated 03.06.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Santosh Jadhav dated 13.06.2022 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation is not filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 03.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
