1. Perused Petition. Heard Ld. Advocate for petitioners. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Ashok Vrajlal Sheth and Swati Ashok Sheth being Executors named under the Will of deceased. The deceased namely Manjula Pranlal Gaglani died at Mumbai on 28.12.2015. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 05.05.2015. The said Will is in Gujarati language and official translation of the said Will received from the office of Chief Translator, High Court, Bombay which is filed separately through e-filing. The Para No.4 of the Will refers to the appointment of Executors. Only five Executors appointed under the Will who are petitioners herein. Out of them two are petitioners and other executors namely Pranlal Bhaichand Gaglani died on 05.11.2022 and Mukesh Chabildas Gaglani died on 16.08.2021 as stated in para No. 5 of the petition. Remaining executor namely Ishwarlal Bhaichand Gaglani has renounced his rights to act as Executor and Affidavit dated 04.05.2023 is filed to that effect. The properties mentioned in Schedule I annexed to the petition are referred in the Will.

3. Ld. Advocate for petitioners submits that parents of deceased predeceased the deceased. Husband since deceased the deceased. Deceased was survived by daughter only who is petitioner No. 2 herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Jaydeep S. Mehta dated 04.05.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 18.12.2025 is filed. Delay is explained and the same is condoned.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
