TP/5606/2024 (E-filing) Mr. Pravin Kadam, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Shahrookh Bomi Davar being grandson of deceased No. 1 and son of deceased No. 2 of deceased. Deceased No. 1 namely Homai Dosabhai Jila died intestate at Kolkatta on 22.05.1999. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 25.07.2024 for dispensation of identification proof of deceased. The same is accepted. Deceased No. 2 namely Khorshed Bomi Davar died intestate at Mumbai on 13.02.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pancard is already annexed to the petition.

2. Ld. Advocate for petitioner submits that Deceased No. 1 is grandmother of petitioner and deceased No. 2 is mother of petitioner. Thus, deceased Nos. 1 and 2 are mother and daughter. Husband of deceased No. 1 died predeceased the deceased. Daughter of deceased No. 1 namely Khorshed died leaving behind three sons. Deceased No. 1 survived by three grandsons. Out of them one grandson is petitioner herein and the other two grandsons have given their consents in favour of petitioner. Consent Affidavits are on record. Parents and husband of deceased No. 2 predeceased the deceased. Deceased No. 2 was survived by three sons. Out of them one son is petitioner herein and the other two sons have given their consents in favour of the petitioner. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 05.07.2025 and Administration Bond dated 08.01.2025 are filed. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
