TP/5630/2024 (E-filing) Ms. Jyoti Badgujar i/b. Lakdwala and Co., Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vivek Satishchandra Mohile being sole Executor named under the Will of deceased. The deceased namely Aparna Satishchandra Mohile died at Pune on 27.07.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Pune on 24.02.2019. The said Will is in English language.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased, who died on 25.02.2002. Deceased was survived by one son and one daughter. Out of them son is petitioner herein and daughter namely Renuka Mohile is mentally retarded person. Copy of order dated 17.01.2022 passed by under National Trust Act, 1999 appointed the petitioner herein Vivek S. Mohile as legal guardian of said daughter is annexed to the petition as Exhibit "E". There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ranjit Anil Karve dated 21.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 02.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
