TP/5640/2024 (E-filing) Ms. Yogini Gada, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Rajesh Taru Lalwani being one of the Executors named under the Will of deceased. Deceased namely Taru Jagtari Lalwani said to have died at Mumbai on 27.01.2020. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Aadhaar Card and Pancard are annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 11.03.2011. The said Will is in English language. Petitioner is one of the Executors and remaining two Executors namely Taru Sarita Lalwani and Rishi Taru Lalwani died and their death certificates are annexed to the petition at Exhibits - "D" and "E".

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Wife of deceased predeceased the deceased who died on 03.11.2017. Son of deceased namely Rishi Taru Lalwani since deceased the deceased who died on 09.07.2023 leaving behind his widow, one daughter and one son. Deceased was survived by one son, daughter-in-law, granddaughter and grandson. Out of them son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dr. K. N. Sanklecha dated 12.09.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 28.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
