TP/5644/2024 (E-filing) Ms. Arunima Athavale i/b. Keystone Partners, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith copy of Codicil of deceased filed by petitioners namely Rajen Dwarkadas Udeshi (son of deceased) and Piyush Liladhar Jesrani (son-in-law) both being Executors named under the Will of deceased. Deceased namely Muli Narotamdas Toprani said to have died at Mumbai on 17.06.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 29.03.2022 and Codicil was executed on 04.01.2023 however, petitioner was unable to produce the original codicil as the same was misplaced hence, present petition is filed for Probate on the basis of copy of Codicil. The said Will as well as Codicil are in English languages.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased had no son and was survived by three daughters who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Shashwat Rai and Prateek Paid both 30.11.2023 both the Attesting Witness to the Will as well as Codicil are filed. Affidavit of Service of General Citation dated 14.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
