1. Petitioner to take steps to state about the marital status of the deceased.

2. Petitioner to satisfy that surety can honour the amount in both the matters i.e. TP/5952/2024 and in this matter. Furthermore, the petitioner may filed fresh Bond for the gross amount as per the Rule 420 of the Bombay High Court (OS) Rules, 1980. Hence, adjourned.

Advocate for the petitioner moved a praecipe dated 20.02.2025 and thereby seeks permission to amend the petition by making an averment about the marital status of the deceased as per the draft annexed to the praecipe. Submission is accepted. Praecipe is allowed. Furthermore, in view of the death certificate annexed in the TP/5952/2024, re-verification is dispensed with. Petitioner to carry out an amendment within three weeks from the date of uploading of this order, if petition is pending.
