TP/5674/2024 (E-filing) Mr. Anand Tiwari, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. After the order for issuance of grant for Succession Certificate is passed on 15.04.2025, office is able to trace the cross petition in respect of estate of the same deceased namely Nomanbhai Mohamadali Bhimdiwala. The cross Petition being TP No. 839 of 2017 was filed in respect of the same deceased for Succession Certificate and grant has been issued on 29.09.2017. The schedule of the properties shows that the securities mentioned in both the petitions are different and are not same and identical. It is noticed that in both the petitions petitioners have declared themselves as a daughter of deceased and stated that the deceased was survived by only one daughter. However, the name of the petitioner in both the petitions is different.

2. In view of the above, office is directed not to hand over the grant as per order dated 15.04.2025. Hence, parties and Advocates to take steps in accordance with law. Remove from board.
