TP/5680/2024 (E-filing) Mr. A. R. Bapat, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Ramesh Mahabaleshwar Bijoor being sole Executor named under the Will of deceased. The deceased namely Lalita Manohar Udiyaver died at Mumbai on 04.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 11.11.2020. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Husband of deceased died on 16.06.2020. Father-in-law of deceased died on 30.01.1995. Mother of deceased died on 25.03.2006. Deceased died issue-less. Brother-in-law of deceased also died issue-less. Brother of husband of deceased died on 12.11.2013, leaving behind one daughter and two sons who are legal heirs mentioned in para No. 10 of the petition. All three legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Deepak Mangesh Hemmady dated 19.11.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 24.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
