Heard Ms. Bhagwat, learned Advocate for Petitioners. 2.

Testamentary Petition is filed seeking Letters of Administration with Will annexed to the property and credits of the deceased.

Both the Petitioners are sons of the deceased. There is no reasons whatsoever to raise the requisition which is raised in the order dated 24.02.2025. Basic requirement stands fulfilled by both the Petitioners.

The capacity of Petitioners is that they are sons of the deceased and therefore entitled to the property and credits of the deceased being the legatees thereto.

In any event, issuance of legal heirship certificate does not determine entitlement or title to any of the properties. It only declares heirship.

In that view of the matter, the requisition raised by the Department in the orders dated 07.01.2025 and 24.02.2025 stands dispensed with.
