Advocate for the Petitioner submits that matter is listed before the Hon'ble Court, in respect of the requisition raised about the capacity of the petitioner No.1, as the property which was bequeathed to him in the Will, already gifted by the deceased testator by way of the Registered Gift deed. Hence, petitioner No.1 can not be said to be legatee under the Will, as the property is not available for the testator, at the time of his death. Hence, petition is adjourned at her request.
