TP/5703/2024 (E-filing) Ms. Pradnya Bagde i/b. Seema Hunnurkar, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mini Thomas Varghese being sole Executrix named under the Will of deceased. The deceased namely Thresiamma C T Verghese died at Mumbai on 08.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 14.11.2023. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased was survived by one son and one daughter. Daughter has been served through RPAD through office of Sheriff of Mumbai and Affidavit of Service dated 05.03.2025 is filed to that effect. Petitioner is daughter-in-law of deceased. Consent Affidavit of son of deceased is not filed or Service of citation is required to be served.

4. Petitioner's oath is filed. Affidavit of Cyprian Raymond Pinto dated 26.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 03.01.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when all compliance is done in this matter. Hence, remove from board. 11.06.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
