TP/5705/2024 (E-filing) Mr. Cessar Pereira, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Pratik Harshadbhai Palejwala being nephew of deceased No. 1 and son of deceased No. 2. Deceased No. 1 namely Chandraprabha Shroff alias Rekha Jayantilal Shah said to be died intestate at Mumbai on 14.05.1997. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased viz. copy of Pan Card is already annexed to the petition as Exhibit - "B". Deceased No. 2 namely Hemangini Shroff alias Hemaben Harshadbhai Palejwala said to be died intestate at Mumbai on 11.03.2007. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased viz. copy of Pan Card is already annexed to the petition as Exhibit - "B".

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Husband of deceased No. 1 namely Jayantilal Bhogilal Shah died on 10.05.1985. Husband of deceased No. 2 namely Harshadbhai Chandravadanabhai Palejwala died on 17.02.2004. Deceased No. 1 died issueless. Deceased No. 1 was survived by nephew and niece and deceased No. 2 was survived by son and daughter. Out of them petitioner is nephew of deceased No. 1 and son of deceased No. 2 and niece of deceased No. 1 and daughter of deceased No.2 has given her consent. Consent Affidavit is on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 16.01.2025 and Administration Bond dated 16.01.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
