Ld. advocate for the petitioner submitted that the authority has issued the certificate in respect of the Minor's Guardianship. However, upon querry, Ld. advocate for the petitioner submitted that the no security has been given as per provisions of the Rule 422(1) of the Bombay High Court (OS) Rules,1980, which is reproduced hereinbelow, - Rule 422(1) When the person to whom the grant is made has taken out letters of administration or succession certificate for the use and benefit of a lunatic or person of unsound mind, unless he be a committee of the estate of such lunatic appointed by the Court and has given security. Petitioner to satisfy that requisition of Rule 422 (1) of the Bombay High Court (O. S.) Rules, 1980 is complied with by showing that proper security is given while obtaining the order of guardianship.

The Letters of administration is taken out for the benefits of the minor, namely Charulata Limaye, hence, the petitioner to comply the provisions of the justify the surety in terms of the above referred provisions. 3.
