TP/5755/2024 (E-filing) Mr. Subhash Khade, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Bhavika Jignesh Shah being one of the Executors named under the Will of deceased. The deceased namely Jignesh Promodchandra Shah died at Mumbai on 03.05.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 09.12.2022. The said Will is in English language. The Page No. 6 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will. Petitioner is one of the executors and Affidavit of another executor namely Ashwin Ramniklal Parmar has not filed for renouncing or reserving his rights.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by widow, one minor son and one minor daughter. Out of them widow is petitioner herein and being mother and natural guardian of minor son and minor daughter, petitioner has consent on behalf of them. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Pooja Nikhil Malkan and Sarju Keyur Shah dated 09.10.2023 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 04.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
