1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jennifer Ranjan Patil being sole Executor named under the Will of deceased. The deceased namely Hermigilda Joaquim Colaco is said to have died in Canada on 09.12.2023. Copy of the death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Canada on 27.04.2018. The said Will is in English language. The page No. 3 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased died as a widow. Deceased had three sons and three daughters. One son of deceased namely Christopher Paul Colaco died on 11.12.2016, leaving behind his wife and two sons. Deceased was survived by two sons, three daughters, daughter-in-law and two grandsons. Out of them daughter is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Jeffrey Neumann dated 12.06.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 17.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
