The petitioner has funished the administration Bond with the surety. However, the said Surety is the Advocate's Clerk. As there is no provisions in the the Bombay High Court (OS) Rules, 1980 for determining the capcity of the person to give surety to the administration Bond. However, person working in the Court, can not be accepted as a surety to the administration Bond. Hence, it would be proper to seek direction from the Court in respect of the acceptance of the Administration Bond with such surety. Hence, the Ld. Advocate for the petitioenr may seek direction from the Hon'ble Court in this regard.
