TP/5787/2024 (E-filing) Mr. R. T. Kharwar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities jointly belonging all three deceased filed by petitioners namely Rekha Govindji Dawda, Minesh Govindji Dawda and Himanshu Govindji Dawda being brothers and sisters of deceased. Deceased Nos. 1 to 3 namely Gunvanti Goindji Dawda, Govindji Jamnadas Dawda and Nayna Govindji Dawda died intestate at Mumbai on 29.03.2005, 03.04.2012 and 14.02.2016 respectively. Copy of death certificate is annexed to the petition. Petitioners have filed Affidavit dated 21.10.2023 for dispensation of identification proof of deceased. The same is accepted.
2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased Nos. 1 and 2 are husband and wife. Petitioner No. 3 is daughter of deceased Nos. 1 and 2 who died as spinster. Deceased Nos. 1 and 2 were survived by two sons and one married daughter who all are petitioners herein. All the petitioners are the brothers and sister of deceased No. 3. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 17.01.2025 is filed. Since, all the surviving legal heirs are the petitioners herein hence, Administration Bond is not required to file. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
