TP/5800/2024 (E-filing) Ms. Pankti Sanghavi i/b. Sandeep Manubarwala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last joint Will and Testament of deceased filed by petitioner namely Ajit Singh Amarjit Singh Arora being sole Executor named under the Will of deceased. The deceased No. 1 namely Amarjit Singh Bishan Singh Arora died at Mumbai on 07.02.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition. The deceased No. 1 namely Inderjit Kaur Amarjit Singh Arora died at Mumbai on 05.03.2018. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Both the deceased left behind their last Will and Testament which was duly executed at Mumbai on 13.01.2015. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that deceased Nos. 1 and 2 are husband and wife. One son of both the deceased namely Perminder Singh Arora died on 21.03.2008 leaving behind his widow, one son and one daughter. Both the deceased were survived by one son, one daughter, one daughter-in-law, one grandson and one granddaughter. Out of them son is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Ranjeet K. Nag dated 20.09.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 10.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
