TP/5819/2024 (E-filing) Mr. Ajit S. Hodage, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Mohammadali Kadar Sayyad s/o. Badwa Kaka Kadar being son of deceased. Deceased namely Badwa Kaka Kadar alias Baduva Kaka Kadar said to be died intestate at Mumbai on 22.08.1990. Copy of death certificate is annexed to the petition as Exhibit - "A". Petitioner has filed Affidavit for dispensation of identification proof of deceased which is annexed to the petition.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased namely Aminabi Kadar died on 06.04.2011. Deceased had no daughter and was survived by one son only who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 07.01.2025. As all surviving legal heirs of the deceased are petitioners before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
