TP/5823/2024 Ms. Hardik Sanghavi i/b. M/s. Agurd Partners, Advocates for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts and securities belonging to deceased filed by three petitioners namely Pramod Kumar Khimji Meghji Shah, Rajesh Kumar Khimji Meghji Shah and Dhirajlal Khimji Meghji Shah, sons of the deceased respectively. All three petitioners have filed petition through their Constituted Attorney Mr. Yusuf Patel. The petitioners have verified the petition through Constituted Attorney Mr. Yusuf Patel the POA dated 13.12.2023 and another POA dated 27.12.2023. Deceased namely Kasturben Khimji Meghji Shah, said to be died intestate at Nairobi, in Republic of Kenya on 30.12.2017. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased viz. copy of Pancard is already annexed to the petition as Exhibit - "A-1".

2. Ld. Advocate for petitioner submits that Husband of deceased predeceased the deceased. The parents of the deceased predeceased the deceased. Deceased was survived by three sons, who all are petitioners herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 10.02.2025 filed separately through e-filing. All legal heirs are Class-I legal heirs, hence Administration Bond not required. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.

4. Office to issue Succession Certificate as prayed after verifying whether any cross petition is filed or whether any Affidavit opposing grant is filed.
