TP/5841/2024 (E-filing) Mr. Yash R. Balle i/b. VJ Juris, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Nidhi Pawan Moorjani being one of the Executors named under the Will of deceased. The deceased namely Vishindas Sukhija died at Haryana on 02.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 17.12.2003 and Codicil was duly executed at Mumbai on 11.05.2025. The said Will and Codicil are in English languages. The Para No. 2 of the Codicil refers to the appointment of Executor. Only one Executor appointed under the Will and Codicil who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by one son and one daughter. Out of them daughter is petitioner herein and consent Affidavit of son of deceased is not filed hence, Advocate to take steps.

4. Petitioner's oath is filed. Affidavit of Attesting Witness to the Will as well as Codicil are not filed. Affidavit of Service of General Citation dated 17.01.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 18.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
