1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Nidhi Pawan Moorjani being one of the Executors named under the Will of deceased. The deceased namely Vishindas Sukhija died at Haryana on 02.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 17.12.2003 and Codicil was duly executed at Mumbai on 11.05.2025. The said Will and Codicil are in English languages. The Para No. 2 of the Codicil refers to the appointment of Executor. Only one Executor appointed under the Will and Codicil who is petitioner herein. Residuary clause in respect of properties of deceased is mentioned at para No. 3 of the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased was survived by one son and one daughter. Out of them daughter is petitioner herein and son of deceased namely Sunil has been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 05.02.2026 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Nandlal Rohera dated 24.09.2024 one of the Attesting Witnesses to the Will is filed. Affidavit of Ramma Rangwani dated 25.09.2024 one of the Attesting Witnesses to the Codicil is filed. Affidavit of Service of General Citation dated 17.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
