TP/5842/2024 (E-filing) Mr. Deep Thakkar, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioner namely Kantaben Shantilal Shah being mother of deceased. Deceased namely Deepak Shantial Shah said to be died intestate at Mumbai on 08.03.2023. Copy of death certificate is annexed to the petition as Exhibit - "A". Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition as Exhibit - "B".
2. Ld. Advocate for petitioner submits that second wife of deceased died on 08.03.2023. There is no issue from the second wife. Deceased left behind him two daughters from the first wife. Deceased had divorced to the first wife. Copy of divorce decree passed by the 5th Family Court, Bandra, Mumbai in Petition No. F. 1230 of 2021 is annexed to the petition as Exhibit - "D". Deceased was survived by mother and two daughters. Out of them mother is petitioner herein and both daughters have given their consents. Consent Affidavits are on record. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 03.02.2025 and Administration Bond is filed dated 30.01.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
