This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Dara Ardeshir Desai being son of deceased. Deceased namely Ardeshir Nowroji Desai died intestate at Mumbai on 13.10.1994. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 21.09.2024 for dispensation of Identification proof of deceased. The same is accepted.

2. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Wife of deceased died intestate on 30.01.2008. Parents of wife of deceased predeceased to her. Deceased had no daughter and was survived by one son only who is petitioner herein. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 21.01.2025 is filed. As surviving legal heir of the deceased is petitioner before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
