TP/5859/2024 (E-filing) WITH WILL/2337/2024 Ms. Komal Patel i/b. Jadeja Satiya, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Devendra Bipinchandra Doshi and Ketan Bipinchandra Doshi being Executors named under the Will of deceased. Deceased namely Bipinchandra Narottamdas Doshi alias Bipinchandra Doshi alias Bipinchandra said to have died at Mumbai on 02.06.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind his last Will and Testament which was duly executed at Mumbai on 22.12.2022. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased had no daughter and three sons. One son of deceased namely Rajendra Bipinchandra Doshi predeceased the deceased. Deceased was survived by two sons, one daughter-in-law, one granddaughter and one grandson. Out of them both the sons are petitioners herein and all all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Atul Kantilal Shah dated 02.04.2024 and Hemant Anantrai Shah dated 02.04.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 15.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
