TP/5884/2024 (E-filing) Mr. Rahul P. Jain, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Succession Certificate in respect of certain securities belonging to deceased filed by petitioner namely Nozer Nariosang Bhathena being nephew of deceased. Deceased namely Firoz Darabsha Bhathena died intestate at Mumbai on 26.04.2006. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 28.10.2024 for dispensation of identification proof of deceased. The same is accepted.

2. Ld. Advocate for petitioner submits that deceased died as widower and issue-less. Parents and wife of deceased predeceased the deceased. Deceased had no sister and had two brothers. One brother of deceased namely Nariosang Darabsha Bhathena died on 23.05.1993 leaving behind two daughters and one son. One daughter namely Kate Nariosang Bhathena died as spinster on 05.04.2021. Deceased was survived by one brother, one niece and one nephew. Out of them newphew is petitioner herein and all other legal heirs have given their consents in favour of petitioner. Consent Affidavits are on record. There are no other legal heirs.

3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 17.01.2025 and Administration Bond dated 09.01.2025 are filed. Delay is explained. All other legal formalities are complied with. Hence, petition is granted.
