TP/5901/2024 (E-filing) WITH WILL/2350/2024 Ms. Shubhangi Chorge i/b. Raviraj Gamare, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Gretta Sabby Vaz being sole Executor named under the Will of deceased. The deceased namely Lily Intaru Dsouza died at Mumbai on 11.03.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 27.10.2021. The said Will is in English language. The Page No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The properties mentioned in the Schedule I annexed to the petition is referred in the Will.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased had one son and one daughter. Daughter of deceased namely Jacinta died leaving behind two daughters. Son of deceased namely Micheal died as bachelor. Deceased was survived by two granddaughters. Out of the one granddaughter is petitioner herein and another granddaughter has been served with the citation through the office of Sheriff, Mumbai and Affidavit of Service dated 24.02.2025 is filed to that effect with remarks "Unclaimed" however, Petitioner to serve the citation upon the granddaughter of deceased namely Janet Mendonca through office of Sheriff, Mumbai by hand delivery.

4. Petitioner's oath is filed. Affidavit of Vijay Tukaram Giri dated 19.11.2025 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 31.01.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is completely ready for final grant.
