TP/5903/2024 (E-filing) Ms. Seema Hunnurkar, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Anand Ashok Gohil, Amit Ashok Gohil and Akash Ashok Gohil being Executors named under the Will of deceased. The deceased namely Devi Rameshkumar Roy died at Mumbai on 04.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 22.02.2017. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will.

3. Ld. Advocate for petitioner submits that husband and parents of husband of deceased predeceased the deceased. Deceased died issue-less. There are no legal heirs from the husband side of deceased. Deceased had no sister and had only one brother. The said brother predeceased the deceased, who died leaving behind three sons and one daughter. Deceased was survived by three nephews and one niece. Out of them all three nephews are petitioners herein and one niece has given her consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dinesh Bhanji Sumra dated 13.11.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 03.01.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
